under the precedents and practices of the Senate, upheld the Schumer
point of order that Impeachment Article I does not allege conduct that
rises to the level of a high crime or misdemeanor as required under
Article II, section 4, of the United States Constitution and is
therefore unconstitutional. Subsequently, the point of order was well
taken and the article falls. (By 49 yeas to 51 nays (Vote No. 131),
Senate earlier failed to table the point of order.)
